Ad-Hoc ATE Insurance provides reassurance to those parties involved in litigation to pursue a justified claim or defence against a third party. Removing from the insured the threat of increased and potentially devastating financial loss by pursuing their case to Trial if needs be.
Ad-Hoc ATE Insurance gives confidence to the litigant to pursue the matter until they are satisfied that any offer of settlement is reasonable. ATE Insurance will usually cover the cost of pursuing the matter after a Part 36 Offer has been refused if agreed with the insurer first. Ad-Hoc ATE Insurance is the process of applying for ATE Insurance cover on a case by case basis. Law Firms can prefer ad-hoc applications for a variety of reasons.
- Law Firms who conduct a variety of case types may not feel that joining a scheme is warranted
- Law Firms sometimes prefer to have Guardian Legal Services research the market for the most appropriate policy believing that ‘one size' does not fit all
- Many cases particularly commercial disputes are not conducted under a CFA and might not be appropriate to a scheme
- Law Firms might be a member of a scheme for their personal injury cases but might find that a particular case type is not covered within the personal injury scheme e.g. clinical or dental negligence claims
- Law Firms might run a departmental scheme operated by an insurer for say personal injury but their probate or commercial department has a case they want covered and their scheme insurer can't help
- The Law Firm simply doesn't run a critical mass of cases sufficient to obtain membership of a scheme
- The Law Firm is running a high value case unsuited to a delegated authority scheme and requires an ad-hoc policy with a tailored limit of indemnity
- The multi-defendant nature of the case makes it unsuitable for a particular scheme
- The Law Firm perceives an advantage in using the highly experienced underwriting staff to provide independent evaluation as to the strength of the case
