Guardian Legal Services are specialists in the field of arranging ATE Insurance on Clinical Negligence matters. We have arrangements with specialist underwriters from all the leading insurers and can arrange ‘After the Event insurance’ for all types of Clinical and Dental Negligence litigation. We will provide quotations on an Ad-Hoc basis for individual one off cases or for firms with a dedicated Clinical Negligence Dept we can provide membership to a number of ‘Delegated Authority Schemes’ according to your requirements. Membership of a DA Scheme can have considerable benefits for Firms , giving secure pass worded web access to your own dedicated portal via the Internet it will allow the Firm to issue policies themselves subject to certain criteria without having to complete lengthy proposal forms and provide expensive expert reports and Counsel’s Advice in every case. It isn’t necessary for the firm to be a member of AvMA or the Law Society’s Clinical Negligence Panel. We just need to satisfy ourselves that the Firm or the Solicitor has a demonstrable level of expertise in the area of clinical negligence cases.
We have access to in house medical expertise and after making an informed assessment of the case we forward the application and associated information to the appropriate insurers for their consideration. We make no charges for case reviews and are happy to advise and assist you with the preparation of your insurance application.
All policies offered by our panel of insurers are protected by the FSA Compensation Scheme and will be deferred until the end of the case and are only payable only upon a successful outcome. Only minimal reporting is required by the insurers on our panel and assistance and advice is given on all matters regarding the eventual recovery of the premium.

So your client pays nothing upfront and if the case is lost or abandoned the premium is waived (subject of course) to the conditions of the policy

- Septicemia, MRSA and C Difficile and other Hospital acquired infections
- Dental Negligence
- Complaints relating the question of lack of ‘Informed Consent’ by the patient
- Misdiagnosis resulting in injury, pain or loss to the patient
- Incorrect or inappropriate proscribing of drugs or medication
- Cosmetic Surgery
- Incorrect or inappropriate surgical intervention
- Complaints relating to negligent care by a Nursing Home or Hospital
- Late diagnosis resulting in exacerbation of a condition, and/or pain or loss to a patient
- Orthopeadic issues including hip and joint replacements
- Amputation Cases including where amputation may have been prevented if a pre-existing condition had been identified e.g. diabetes
- Cerebral Palsy
- Neurological Injuries including problems resulting from a problematic births/delivery
- Ophthalmic Cases
- Birth Injuries claims
- Dependency and/or bereavement claims in the event of Suicide by a patient in the care of a Psychiatric Unit
